Regularisation: What happens to employer if application is rejected?
My fiancée was given an expulsion order and held in an immigration detention centre
20th August 2009: Question: The employer of my fiancée has agreed to regularise her status in Italy. My fear is that my fiancée in the past was given an expulsion order and was held in an immigration detention centre for two months. Unfortunately we don’t have at hand the expulsion order she was given in order to know the reason indicated on it (probably she was given an expulsion order because she didn’t have the Permit of Stay). My question is, what does the employer risk should my fiancée’s application for regularisation be rejected?
Answer: Before submitting the application for regularisation, we would advise you to contact the Questura (police station) and confirm the reason stated in her expulsion order. Please find out if it had something to do with criminal conviction. Having being held in the immigration detention centre, may be it had something to do with security reasons. It is better you check this out before submitting the application because if your fiancée was expelled for security reasons, then her application for regularisation will be rejected. And once the application is rejected, the employer risks being charged with employing an illegal immigrant if he continues to employ the illegal immigrant.
