Regularisation: How can I withdraw application?

Question: Hi! I applied to regularise an illegal worker. But before the application was processed, the worker was issued a Permit of Stay for family reasons. Now I’ve received a letter summoning me and the worker to the Immigrations Office at the Prefecture to undersign the Residency contract (Contratto di soggiorno). What should I do to withdraw the application? Thanks.

Answer: Normally if you are summoned to the Immigrations Office and you fail to report, they summon you again. But if you fail to report for the second time, they archive your application.

In case of an employer who applied to regularize an illegal worker, failing to report can lead to serious problems with the law because the offence of hiring an illegal worker is only extinguished if the application for regularization is accepted. However, in your case there is no problem at all because the worker you wanted to regularize has already been issued the Permit of Stay. In case the worker no longer works for you, should notify both INPS and the Immigrations Office at the Prefecture by sending a registered mail with return-receipt requested.
