Can expelled failed asylum seeker be regularised?

Question: I came to Italy in November 2011 and applied for asylum. My application was rejected and the Asylum Commission gave me time to appeal their decision but I didn’t appeal. Some days later the police gave me an expulsion order to leave Italy by 26th July 2012. Can I apply to be regularised?

Answer: If your application for asylum was rejected simply because the Commission wasn’t convinced you deserved being given protection, then you can apply to be regularised. You must however have an employer willing to apply for your regularisation, and must have been working for them for at least three months.

When you apply for asylum and your application is being processed, normally you are issued a temporary Permit of Stay. You can use your expired permit to prove that you were in Italy by 31st December 2011.
